Memorandum of Understanding (MOU) The State Highway Administration will prepare an MOU for each project, and send the draft to the project sponsor for review. The MOU will outline the following:
- Responsibilities of both MDOT and the project sponsor;
- Project description;
- Activities for which federal funds will be reimbursed;
- Activities that are the project sponsor's responsibility; and
- Provision that will require projects to be advertised within eighteen months from the date of the award letter from the Governor, or funding may be withdrawn to assist other projects move forward that are already to proceed.
Important Note to Project Sponsors The MOU must be executed before the Federal funds are authorized. Federal funds must be authorized before any advertisement activities take place. Projects may not be advertised, or acquisitions of property made, without written SHA approval. Failure to adhere to these requirements will make part or all of the entire project ineligible for reimbursement.
Permits The project sponsor is responsible for obtaining all required permits. The permits will become part of the advertising package. These include, but are not limited to:
- Wetlands (Army Corps of Engineers);
- Erosion/sediment Control;
- Stormwater management;
- Chesapeake Bay Critical Area;
- Building construction (may be obtained by the contractor);
- Access Permits from SHA Engineering Access Permits Division;
- Tree Permits; and
- Utility and other permits, as they pertain to the project.
Important Permit Note to Sponsors
Advertisement will not occur until the required permits are issued.
